Article 1 General
1.1 Before you proceed to an agreement, you must accept the general conditions.
1.2 If you have received jewelry that you have not ordered, then you need to inform BLINCKSTAR a.s.a.p.
Article 2 Realisation agreement
2.1 The agreement to purchase and sale comes about at the moment of acceptance by the consumer of the offer and meeting the thereby stipulated conditions.
2.2 If the consumer has accepted the offer electronically, the entrepreneur immediately confirms the receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the consumer can dissolve the contract.
Article 3 Price increases
3.1 If after the realisation of the agreement the price is increased, you have the right to dissolve the agreement within ten (10) days after notification, unless the price increase is the result of legal regulations or provisions.
Article 4 Delivery costs
4.1 For the delivery you pay standard €3.95 delivery costs. The jewelry will be sent by registered mail with GLS. You will receive a track and trace number. We are not liable for theft or lost mail. Orders above €75 will be sent free of charge in the Netherlands.
Article 5 Cooling down period
5.1 The offer will also include a trial period of fourteen working days, starting the day after receipt by or on behalf of you. (unless otherwise agreed in accordance with paragraph 3.)
5.2 During the trial period you have a right of withdrawal, whereby you have the possibility to return the received goods without any obligation on his part, other than against compensation of the direct costs of return.
5.3 Restrictions or exclusions of the trial period - due to the specific nature of the goods in question - will be clearly stated in the offer.
5.4 During this period you should handle the product and its packaging with care. You should only unpack or use the product to the extent necessary to assess whether you wish to keep the product. If you exercise your right of withdrawal, you must return the product with all delivered accessories, including price tags and free promotional items - if reasonably possible - in the original packaging to BLINCKSTAR, in accordance with the instructions provided by BLINCKSTAR. For hygienic reasons earrings can only be returned or exchanged if they have not been used and the price tags are still attached.
5.5 The shipping costs of returns are for the account of the buyer.
5.6 In case of prepayment BLINCKSTAR will refund the purchase amount to you as soon as possible, excluding the paid costs of the return shipment.
5.7 Items purchased in the sale will not be refunded with a refund of the amount to your account, but will be taken back with a voucher as a payment, which can only be used on the website.
Article 6 Delivery period
6.1 We strive to deliver the product between 2 and 5 working days. If the jewelry is not in stock or for any other reason there is a delay, or an order can not or only partially carried out, you will receive a message as soon as possible and in that case you have the right to cancel the order without charge.
Article 7 Prices and payments
7.1 All mentioned prices in the E-boutique are inclusive B.T.W. and exclusive sending costs. Before the agreement is closed the total price will be visible.
7.2 Payments must be made via online payment or via advance payment via ING account number: NL91INGB0004209346 in the name of BLINCKSTAR, in Groenekan.
Article 8 Defective product
8.1 BLINCKSTAR recommends to inspect the delivered goods immediately after receipt and to report any defects within 3 days at the latest.
Article 9 Guarantee
9.1 BLINCKSTAR guarantees that the products and/or services comply with the agreement.
9.2 However, the buyer cannot appeal to warranty in case of:
a. normal wear and tear;
b. changes made to the article by or on behalf of the buyer;
c. damage due to intent or gross negligence;
d. repairs made by the buyer or by third parties engaged by the buyer on its own initiative during the warranty period to the delivered articles.
e. damage by perfume or water.
Article 10 Ownership
10.1 The ownership of supplied products is only about, if the consumer has paid all what the consumer on the basis of the on the matter of the supplied products closed agreement(s) to BLINCKSTAR has owed.
Article 11 Force majeure
11.1 In case of force majeure BLINCKSTAR is not obliged to compensation of the damage that has arisen as a result at the consumer, except and as far as consumer as a result of the force majeure situation has had an advantage that he would not have had at correct observance.
Article 12 Applicable law
12.1 On the agreement and these general conditions only the Dutch law is applicable.
Article 13 Complaints and Disputes
13.1 It can occur that you are not satisfied with a product and/or service. Please contact us as soon as possible, preferably by e-mail via: email@example.com. We will respond to your complaint within 5 days at the latest.
13.2 If the dispute does not come to a solution, each of the parties is authorized to submit the dispute to the competent court.
*PLEASE NOTE: Earrings can not be exchanged or returned due to hygienic reasons, except when not worn.
